BOOKING & CANCELLATION

  • By purchasing travel services from Gibbon Adventure Sdn Bhd, you enter into a contract with the company and acknowledge your agreement to their outlined terms and conditions. It is important to thoroughly read and understand these terms before making a reservation.

Deposit and final payment.

Upon confirmation of your service, a deposit of 40% must be made to secure your booking. Your booking will not be considered confirmed until Gibbon Adventure Sdn Bhd receives the deposit and sends you a confirmation invoice. Gibbon Adventure Sdn Bhd reserves the right to cancel any bookings that do not receive the deposit by the due date. By making the deposit payment, you acknowledge that you have read and agreed to these terms and conditions.

Please thoroughly review your booking invoice and let us know right away if there are any errors or missing information. In the event of billing errors, Gibbon Adventure Sdn Bhd reserves the right to re-invoice with the correct pricing. 45 days before the commencement of your services, you must make the last payment on your reservation. Your reservation will be cancelled and Gibbon Adventure Sdn Bhd is entitled to keep the entire deposit if the last payment is not made by the deadline. If payment is not made by the final payment date, Gibbon Adventure Sdn Bhd will not be held responsible for cancelled of land and/or air arrangements.​

If a booking is made within 30 days of arrival, full payment is required at the time of booking.

Mt. Kinabalu Tour packages.

Full payment is necessary upon confirmation and these bookings have a firm policy of no refunds or cancellations. No exceptions will be made in the event of any cancellation. Please note that this policy is established by the operators, not by Gibbon Adventure Sdn Bhd. In case of a no show, no refund will be provided as the reserved accommodation is considered used.

Airfare / Flight Ticket

Full payment is required for the purchase of airfares. T&C apply.

Cancellation made by you.

Standard Cancellation Policy

The following cancellation fees apply to all booking cancellations:

  • Less than 15 days or No Show: 100% of the tour cost forfeited.
  • 15 to 24 days prior to arrival date: 95% of the tour cost forfeited.
  • 25 to 44 days prior to arrival date: 75% of the tour cost forfeited.
  • 45 days or more prior to arrival date: 50% of the tour cost forfeited.

For tours or individual components provided by third-party suppliers—such as plane tickets and hotel/lodge bookings—the cancellation fees specified in the terms and conditions of the relevant third parties will apply.

If a participant needs to delay, reschedule, or cancel their trip due to health-related reasons, a medical note or letter from a doctor will be required. Gibbon Adventure Sdn Bhd will strive to accommodate their needs, but the terms and conditions of any applicable third-party suppliers will govern changes to the participant’s itinerary.

Please note that some tours, such as the Mt. Kinabalu Climbing package, diving packages, and certain others, have their own cancellation policies. These policies are outlined on the individual tour pages for your reference.

Tour postponement.

We offer a flexible postponement policy allowing you to reschedule up to 45 days before your trip. In this case, your payments will be credited for future use and will remain valid for 12 months from the original travel dates. Please note that changes to your itinerary may be subject to the terms and conditions set by third-party suppliers, which may include standard annual price increases.

After 12 months, the management will evaluate unused credits on a case-by-case basis. However, once your tour has begun, no refunds or exchanges can be made for unused services such as accommodations, meals, sightseeing tours, transportation, or any other tours elements included.

Refund of unused services.

No refunds or exchanges will be provided for any unused tour elements such as accommodation, meals, sightseeing tours, transportation, or any other included services, even after the tour has commenced.

Payment Methods.

Gibbon Adventure Sdn Bhd offers a range of payment options via telegraphic transfers an e-Wallet, in Malaysian Ringgit (MYR). They are listed below in their ease of payment for both participants and Gibbon adventure Sdn Bhd. Any E-Wallet and/or bank transfer fees will be borne by participants.

Participant with special needs.

It is important for customers to inform us of any physical or mental conditions of any member of their traveling party before booking. This information helps us ensure that the tour is suitable for all participants.

In the event that we believe a tour would not be suitable for a person with specific needs, we reserve the right to decline their participation. Failure to disclose these conditions prior to booking will exempt Gibbon Adventure Sdn Bhd from any liability for providing an unsuitable tour.

Travel documents and visa

It is the responsibility of the client to ensure that their passport and visa are valid for at least six (6) months from the date of entry into the destination country. Gibbon Adventure Sdn Bhd will not be held responsible for any expenses, refunds, or reimbursements if the client is not granted entry by immigration authorities for any reason and as a result is unable to participate in the tour.

Travel insurance

To ensure a safe and enjoyable trip, clients are strongly encouraged to purchase a comprehensive personal travel insurance policy that covers various risks, such as personal accident, loss of baggage, travel disruptions, cancellations, natural disasters, medical emergencies, and more. It is important for clients to be in good health to fully participate in the tour.

For those planning to do mountain climbing or Maliau Basin expedition, it is recommended to undergo a medical check-up before the trip. Additionally, climbers with pre-existing medical conditions should inform Gibbon Adventure Sdn Bhd and consult their doctor for any necessary vaccinations and medical requirements.

Confidentiality

Gibbon Adventure Sdn Bhd will safeguard, according to strict standards of security and confidentiality, any information on the Client. The Company limits collection and use of client’s personal particulars/information to the minimum; and for the purpose of completing the transaction as well as facilitating smooth delivery of services and every effort shall be made to ensure the integrity of the client’s personal particulars and confidential information entrusted to the Company are not compromised.

Gibbon Adventure Sdn Bhd also undertakes not to divulge the client’s personal information to any unauthorized third party without prior consent. We shall only use these data to deliver marketing materials related to The Company’s services.

Risk management

On our adventure tours which include Mount Kinabalu Expedition, Maliau Basin Expedition, Danum Valley tour Packages, Long Pasia Expedition, and few others, the location is in areas where it is less accessible and the events that may occur in such places are less predictable. There will be elements of uncertainty as we are visiting places where the political, cultural and geographical attributes present certain risks, dangers and physical challenges greater than those present in our daily lives.

Gibbon Adventure Sdn Bhd put every effort to ensure comfortable travelling of the Client, but the Company seeks mutual understanding that certain parts of the destinations will not have the same facilities, emergency, healthcare and safety services of the same quality level as what the Client may be accustomed to in their own country. Road travel may be uncomfortable or even unreliable at times. Client may possibly encounter power failure, insufficient water and limited food selection in remote areas. It is a fundamental condition that the Client acknowledges that all adventure tours require some flexibility and the most meticulously planned arrangement can go wrong.

The day to day itinerary is an indication of what the group should accomplish, but not a contractual obligation. It is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events, which may include sickness or mechanical breakdown, flight or rail cancellations, strikes, events emanating from political disputes, entry or border difficulties, climate and other unpredictable or unforeseeable circumstances. Therefore, the Company will make the necessary changes in view of the safety and best interest of the Client. These amendments may be made with or without the consultation of the Client.

Nonetheless, the Company will do everything within our control to minimize the effects of the enforced changes. The Company, however, cannot be held responsible for the results of these changes, regardless of how they were caused.

Limitation of Liability

Gibbon Adventure Travel and Tour shall be exempted from liability for loss, injury or damage to property or personal accidents, delays irregularities or the occurrence beyond our control. Every person participating in any tour organized by Gibbon Adventure Travel and Tour shall be regarded as carrying his own risk with respect to loss or injury to person or property.

Force Majoure

Gibbon Adventure Sdn Bhd shall not be liable where the contract is affected by ‘force majeure’. In the context of these terms and conditions, ‘force majeure’ is any event that is beyond the reasonable control of the Company or which are unavoidable by the exercise of due diligence on the Company’s part including but not limited to war, threat of war, riot, civil commotion or strife, hostilities, industrial dispute, natural disaster, fire, acts of God, terrorist activity, nuclear disaster, adverse weather, government action or technical problems with transportation.

Possible Changes

It is possible that due to inclement weather or any other unforeseen circumstances that itinerary or routings could be changed. Arrangements of the similar standard will be substituted, should it occur. However no refunds will be available. Gibbon Adventure Sdn Bhd reserves the right to make changes to travel arrangements at any time without compensation. All prices quoted in the website are correct at the time of publication and are subject to change without notice in the event of unforeseen circumstances such as currency fluctuations, increase in transport costs, hotel rates, government tax etc.

Client's Comment

Any comments regarding complaint/claims should be lodged in writing with supporting documentation to the Company within 7 days from date of return.
